StampCam Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the StampCam application for Android and iOS, operated by Hui Quan Zhong, an individual developer ("StampCam", "we", "our", or "the app"). By downloading, installing, accessing, or using StampCam, you agree to these Terms. If you do not agree, do not use the app.

If you build, modify, repackage, or distribute a version of StampCam, you are responsible for obtaining any required authorization and complying with applicable licenses, branding rules, platform requirements, and laws. You may not present an unofficial build as an official StampCam release.

2. Description of the Service

StampCam is a watermark camera app for Android and iOS. Depending on the release, it may provide features such as:

• photo capture;
• video capture;
• watermark rendering;
• customizable watermark styles;
• optional location, weather, and elevation overlays;
• saving generated content to your device photo or media library.

Some features depend on device permissions and platform availability. StampCam is licensed, not sold, to you. If you obtain StampCam through Apple's App Store, your use of the app is also subject to Apple's applicable App Store terms, Usage Rules, and standard end-user license agreement where applicable. If you obtain it through Google Play, your use is also subject to Google Play terms.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices that you own or control.

You may:

• Use the app for lawful photography, video recording, and record-keeping purposes.
• Use timestamp, location, weather, elevation, device, and custom text watermark features.
• Share media created with the app if your use and sharing are lawful and do not infringe the rights of others.

You may not:

• Use the app for illegal, infringing, deceptive, harassing, or unauthorized purposes.
• Violate privacy, intellectual property, publicity, or other rights of any person or organization.
• Remove or alter proprietary notices, brand identifiers, or copyright notices.
• Interfere with the app's normal operation, security protections, or distribution controls.
• Repackage or distribute modified builds in a misleading way that implies official endorsement.

4. Eligibility and Acceptable Use

You may use StampCam only if you have the legal capacity to agree to these Terms and only in compliance with applicable laws and regulations. You agree that you will not:

• use the app for unlawful, fraudulent, or abusive purposes;
• attempt to interfere with the app's normal operation;
• misuse exported images, videos, or watermark content in a way that violates law or the rights of others;
• use the app to infringe intellectual property, privacy, publicity, or other legal rights;
• reverse engineer, decompile, disassemble, attempt to derive source code from, modify, or create derivative works of the app, except where applicable law expressly permits such activity;
• use third-party services accessed through the app in violation of applicable third-party terms.

5. Permissions and Device Access

Certain features require access to device capabilities, including camera, microphone, photo or media library, location, storage (where applicable), network connectivity, and device time. If you deny or revoke these permissions, or if a capability is unavailable, some features may be limited, disabled, or unable to produce complete output.

6. User Content and Responsibility

You retain your rights to photos, videos, text, and other content that you capture, import, edit, save, or share using StampCam. We do not claim ownership of your content beyond the limited processing required to provide app functionality.

You are responsible for the content you create, process, store, share, or publish. You represent that you have the necessary rights to any content you use with the app, including the right to capture the scene, process the media, and include any watermark information in the output.

7. Privacy

Your use of StampCam is also governed by our Privacy Policy. It explains how local media, settings, location-related features, Firebase Analytics, Firebase Crashlytics, and diagnostic information are handled, including optional weather-related network usage.

8. Third-Party Services

StampCam may use third-party services, including:

• Google Firebase Analytics for usage analytics;
• Google Firebase Crashlytics for crash reporting and diagnostics;
• a third-party weather provider (for example, wttr.in on Android) when weather features are enabled;
• Open-Elevation for elevation lookup when elevation features are enabled;
• Apple platform services and Android system services and app distribution platforms where applicable.

Third-party services are governed by their own terms and privacy policies. We do not control their availability, accuracy, security, or changes. Network-dependent features may be unavailable, delayed, or incomplete.

9. Accuracy of Watermark Information

We aim to provide useful timestamp, location, weather, elevation, and device information, but we do not guarantee that watermark information is complete, current, or error-free. Results may depend on:

• Device GPS, network conditions, sensors, permissions, and system clock settings;
• the timeliness, accuracy, and availability of third-party provider responses;
• manual edits to location, text, style, or export settings;
• encoding, scaling, rendering, and playback differences in downstream workflows.

StampCam is not a certified evidence, surveying, safety, or compliance tool. If you rely on watermarked media for inspections, work logs, construction records, evidence, or other important purposes, you are responsible for independently verifying the exported information.

10. Disclaimer of Warranties

To the maximum extent permitted by law, StampCam is provided on an "as is" and "as available" basis. We do not warrant that the app will be uninterrupted, error-free, secure, suitable for a particular purpose, or unaffected by third-party service issues. We do not guarantee that every generated watermark, export, timestamp, coordinate, weather value, or saved file will always be accurate in every circumstance.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for lost data, lost profits, business interruption, inaccurate output, export failures, or disputes arising from user-created or user-shared content. Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

12. Updates and Availability

We may update, modify, suspend, or discontinue features where reasonably necessary, including for maintenance, security, legal, compatibility, or third-party service reasons. We do not guarantee that every feature will remain available on every device, platform version, or distribution channel.

13. Commercial Features and Distribution

The current release does not necessarily include subscriptions, in-app purchases, account services, or cloud media synchronization. If a future release adds paid or enterprise features, additional terms may apply.

Any redistribution of the app, use of StampCam branding, or distribution of a modified build must comply with applicable licenses and must not mislead users about the source, operator, or official status of the build.

14. Intellectual Property

The app software, app name, interface elements, and original app materials provided by us are protected by applicable intellectual property laws. These Terms do not transfer ownership of the app or its underlying software to you. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose on devices that you own or control, subject to applicable platform Usage Rules.

The app may include third-party or open-source components. Those components remain subject to their applicable licenses. These Terms do not limit rights granted under applicable open-source licenses.

15. Termination

If you violate these Terms or use StampCam in a way that harms users, third parties, the app, or related services, we may restrict or terminate access to branding, distribution channels, or related services where applicable. Sections that by their nature should survive termination will remain effective. You may stop using the app at any time by uninstalling it.

16. Apple App Store Terms

If you obtained StampCam through Apple's App Store, you acknowledge that:

• these Terms are between you and Hui Quan Zhong, not Apple;
• Apple is not responsible for providing maintenance or support services for StampCam;
• Apple is not responsible for claims relating to StampCam except as required by applicable law;
• Apple and its subsidiaries are third-party beneficiaries of the terms applicable to your App Store license and may enforce those terms.

Nothing in these Terms limits rights you may have under Apple's applicable terms or mandatory consumer protection laws.

17. Changes to These Terms

We may update these Terms to reflect changes in functionality, legal requirements, or distribution practices. When we do, we will update the "Last Updated" date above and provide additional notice where appropriate. Your continued use after updated Terms take effect constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by the laws applicable to the operator distributing the app, subject to any mandatory consumer protection laws that apply in your jurisdiction.
